USGS leads the government in developing the List of Critical Minerals. UGS is required to update the List at least once every three years. The process for developing the List of Critical Minerals is laid out in the Energy Act of 2020 (Section 7002).

Formulation and expert input
Formulation: USGS consults with experts in academia, government and industry to incorporate the most advanced science and data
Draft Methodology: USGS drafts a methodology for developing the List of Critical Minerals
Peer Review: The draft is peer-reviewed by experts in the field and published
Draft List: USGS uses the methodology to develop the draft List of Critical Minerals
Interagency input
Secretary input: the Secretary of the Interior has the authority to provide additions to the List
Interagency Comment: the List is revewed by other federal agencies
Public Input
Public Comment: USGS posts the methodology and draft List to the Federal Register for public comment
Publication
The List of Critical Minerals is published and posted to the Federal Register
